The Tax Code Nondiscrimination Rules: Keeping an Eye on the Benefits Provided to the “Prohibited Group”When most of us hear ‘nondiscrimination’, we think of things like age, race, or religion; however, there are nondiscrimination rules under Code §§ 125 and 105 that prohibit health and welfare plans from providing greater benefits to what is known as the prohibited group, i.e., employees that the government deems to be either highly compensated or central to an organization.
In 30 minutes, we’ll talk about which plans these Code sections apply to, who exactly is in the prohibited group, and some red flags to look out for when offering benefits to the prohibited group to avoid running afoul of the §§ 125 and 105 nondiscrimination rules.
